SCOTUS to Decide: Can Feds Disarm Every Pot User in America?
Millions of state-legal cannabis users can't legally own a gun right now—one Supreme Court ruling before July changes everything.
Every cannabis cardholder in America is currently a federally prohibited person. Not a criminal. Not a danger to anyone. Just someone who used a plant that 24 states decided to legalize—and the feds responded by stripping them of their right to bear arms.
That's the reality of 18 U.S.C. § 922(g)(3). Because marijuana remains Schedule I federally, any "unlawful user" of cannabis is barred from possessing a firearm. Fill out ATF Form 4473 honestly and you've just confessed to a federal crime. Lie on it and that's a felony too.

Lower courts have already cracked under the contradiction. The Fifth Circuit struck down § 922(g)(3) in *United States v. Daniels*, ruling it unconstitutional as applied to a marijuana user. Other circuits went the other way. SCOTUS stepping in ends the patchwork—one way or the other, before late June 2026.
For Arizona gun owners, this isn't abstract. The state runs both medical and recreational marijuana programs with hundreds of thousands of active participants. Every one of them currently lives under the shadow of federal prosecution the moment they touch a firearm. The DOJ has already used this statute to prosecute people. This is not a hypothetical threat.

Expect the anti-gun lobby to scream that siding with gun owners here is "dangerous." That's the script. The actual danger is a federal government that exploits its own failed drug policy as a backdoor to quietly disarming millions of law-abiding citizens who have hurt no one.
If SCOTUS applies *Bruen* honestly and consistently, the federal pot-and-guns ban is finished. If the Court blinks or carves out an exception, the pressure shifts immediately to Congress—either reschedule marijuana or write an explicit Second Amendment carve-out for state-legal users.
This ruling lands before July. It affects millions of Americans. And whatever SCOTUS decides will echo through every future gun case that follows.
