Minnesota's Red-Flag Ratchet: 5 Years, Any Cop, No Refund

Judges rubber-stamp 96% of confiscation orders—now Dems want them to last 5 years, file in your driveway, and keep your guns for free.

A 96% judicial approval rate. That's not a legal safeguard. That's a formality with a gavel.

Proposals advancing through the Minnesota Legislature would extend Extreme Risk Protection Orders from one year to **five years**, strip the requirement that police reimburse seized firearms at fair market value, and hand any beat cop—no chief, no sheriff, no command sign-off—unilateral power to file a petition on the spot, standing in your driveway, right now.

Two years ago, Minnesota passed its ERPO law. Now they want to "improve" it. This is how the ratchet works: one notch at a time, always the same direction.

The round-the-clock judicial access provision is the quiet killer buried in this bill. The few hours between a petition and a judge's signature are often the only window a gun owner has to reach a lawyer or push back. **They want that window gone.**

In 2025, ERPO petitions more than doubled to 314—police filed the vast majority. No one in the DFL will tell you how many of those 314 Minnesotans were never charged, never convicted, and never given a real chance to face their accusers before their firearms disappeared into a property lockup for a year. Soon, potentially five.

Rep. Cedrick Frazier, DFL-New Hope, called this legislation something that "saved many lives." Gun owners should treat that for exactly what it is: **messaging**. The NRA has its opposition letter on record with the Senate committee. It hasn't stopped the bill—because at least some Republicans crossed the aisle to clear the tied House committee and keep it moving.

Five-year orders. Any officer can file. No reimbursement. No meaningful judicial scrutiny. No way back in without a hearing they control.

This is the blueprint anti-gun legislators copy-paste into every statehouse that gives them a foothold. Minnesota is just further down the road.

**Minnesota gun owners: the House floor vote is coming.** A 96% approval rate on gun confiscation orders isn't justice—it's a rubber stamp with teeth. Find your legislator at leg.mn.gov and call them today. Tell them five years of due-process-free confiscation is not a compromise—it's a wipeout.

Watch this one. If it passes in Minnesota, your state is next on the list.
