Minnesota's Red Flag Bill: 5 Years, No Crime, No Paycheck

Any cop on scene can pull the trigger on seizure—96% of judges rubber-stamp it—and now they don't have to pay you a dime.

Minnesota's red flag machine isn't just expanding. It's having its brakes ripped out.

Bills moving through both chambers would rewrite the state's two-year-old Extreme Risk Protection Order law in three brutal ways: stretch confiscation orders from one year to **five years**, authorize judges to strip your firearms around the clock—weekends, holidays, 2 a.m.—and let any patrol officer on scene file the petition, not just chiefs or sheriffs.

Read that last part slowly: the officer knocking on your door could initiate the process to seize your guns right then and there.

Then comes the gut punch nobody's talking about loudly enough. The current law requires law enforcement to reimburse owners fair market value for surrendered firearms. This bill **kills that provision**. They want your guns. They no longer want to pay for them.

The NRA delivered a letter directly to a Senate committee calling this exactly what it is: a "gun confiscation" scheme. That letter is one of the few organized voices cutting through a coordinated push from DFL legislators and the Minnesota Chiefs of Police Association—300 department heads providing the law enforcement credibility the bill needs to look reasonable.

It is not reasonable.

Rep. Cedrick Frazier, DFL-New Hope, told a House hearing the original law "has saved many lives and prevented many tragedies." CBS Minnesota printed that claim without challenge. What CBS didn't press him on: **judges granted 96% of ERPO petitions in Minnesota.** That is not careful, individualized judicial review. That is a rubber stamp with a robe on.

In 2025 alone, 314 petitions were filed—more than double the law's first-year total. Richfield Police Chief Jay Henthorne called the surge proof the tool is "successful." Gun owners should call it what it actually is: a system scaling at warp speed, with almost no judicial resistance, now being placed in the hands of every officer on every shift, at every hour.

**No crime. No trial. No jury.** A judge reviews a one-sided petition—often filed by law enforcement with an institutional stake in compliance—and your firearms vanish. Under this expansion, for up to five years.

Here's the alarm bell that should jolt every 2A supporter awake: the bill already cleared committee in the tied Minnesota House. That means at least some Republicans voted yes. This is not partisan gridlock holding the line for your rights. This is **bipartisan erosion**, and it's moving.

Minnesota is the test case. Bloomberg's network, Everytown, and allied statehouse majorities have been running identical playbooks state by state for a decade. If this expansion passes with Republican votes in a tied chamber, that language lands in every left-leaning statehouse docket in 2026—and the floor for "reasonable" gun seizure law just dropped five feet.

**What you do right now:** If you're in Minnesota, contact your state rep and senator today at leg.mn.gov. If you're outside Minnesota, forward this to every gun owner you know in the state. The NRA-ILA is already on the ground—back them up. The window to stop this before it becomes a national template is open. It won't be for long.
