Minnesota's 5-Year Gun Grab—With Zero Reimbursement

The state's red flag law was already unconstitutional. What's moving through the Minnesota legislature right now is something worse.
Here's what's on the table: ERPOs stretched from one year to **five years**. Judges required to sign emergency seizure orders **around the clock, weekends included**. And the provision that drew the least attention but hits hardest—**elimination of the requirement that police reimburse you fair market value** for the firearms they take. Your guns. Gone half a decade. No check.
The bill cleared committee in the 50-50 Minnesota House. That means Republicans crossed the aisle to move it forward. That's not bipartisan courage. **That's bipartisan surrender on the Bill of Rights.**
The NRA didn't mince words in their letter to the Senate committee—they called it exactly what it is: a **"gun confiscation" scheme**. They're right. When 96 percent of ERPO petitions get rubber-stamped by judges and gun owners have no meaningful chance to contest the order before losing their property, that's not due process. That's a rights violation with a gavel on top.
The architect of this push isn't some fringe activist. It's the Minnesota Chiefs of Police Association, whose president Jay Henthorne laid out the goal in plain terms: file the petition on-site, get a judge's signature fast, and "take care of the situation." The original ERPO law passed in 2023 when Democrats ran the entire Capitol. Republicans opposed it then—unanimously. Now some of them are helping expand it.
And expand it has. In the law's first full year, 138 ERPOs were filed. In 2025, that number **more than doubled to 314**. This is not a last-resort emergency tool. It is becoming law enforcement's first call, applied faster and broader with every passing month.
Removing the fair market value reimbursement isn't a line-item budget trim. **It's a punishment mechanism.** That financial requirement was the one friction point—the one cost that might slow a frivolous petition. Kill the cost, kill the accountability. No brakes. No consequences. No ceiling on how far this goes.
