Minnesota's 5-Year Gun Grab: No Hearing, No Refund, 96% Approved
Any cop at your door can trigger it. Judges sign off at 2 a.m. And they just stripped the line that made them pay you back.
The Minnesota legislature is moving to supercharge its two-year-old gun confiscation law, and every single upgrade is designed to make it faster, wider, and harder to fight back against.
The proposed changes stretch Extreme Risk Protection Orders from one year to **five years**. They authorize judges to approve emergency seizures **around the clock — 2 a.m., Christmas morning, whenever**. And they allow **any patrol officer on scene** to file a petition — not a chief, not a sheriff, not anyone with command accountability. Whatever cop shows up at your door.
That last provision is the one that should keep you up at night. The threshold for initiating a gun grab just dropped to a single officer's judgment call.
The bill also quietly killed the line that required police to reimburse gun owners **fair market value** for surrendered firearms. They take your property. They owe you nothing. Zero. Gone.
Here's the number CBS Minnesota buried: in the law's first full year, judges **granted 96% of petitions**. Read that again. Ninety-six percent. That is not due process — **that is a rubber stamp with a robe on it.**
ERPOs are issued *ex parte*, meaning you never speak before a judge strips your rights. You lose your firearms first. You fight to get them back later — at your own expense, with no guarantee of success, and now potentially locked out for half a decade.
Rep. Cedrick Frazier, DFL-New Hope, is carrying the House bill and calls it "legislation that has saved many lives." What the law has actually done is remove firearms from 314 Minnesotans in 2025 alone — the vast majority on police-filed petitions with **no criminal charge, no conviction, and no hearing beforehand.**
The NRA put it plainly in a letter to a Senate committee last week: this is a **gun confiscation** law. They are correct.
Now here's where it gets worse. The bill has already cleared committee in the tied Minnesota House — which means **Republican votes helped move it forward.** The DFL-controlled Senate is running a companion bill through its own panels. Both chambers are on a glide path.
**This is not a warning shot. The assembly line is already running.**
If you are a gun owner in Minnesota, you need to contact your state representative and senator right now — especially any Republican who voted this out of committee — and make it unmistakably clear: a five-year warrantless seizure with a 96% rubber-stamp rate and no reimbursement is not a safety reform. It is a constitutional rights shredder that has never once required a criminal charge to destroy someone's life.
Watch this bill. The Senate vote is coming. And if it passes, every other blue-leaning state legislature is watching to see what they can copy next.
