Minnesota Dems Push 5-Year Gun Grabs, No Reimbursement

DFL bill expands red flag seizures to 24/7, five years, and sticks you with the bill — some Republicans may let it happen

Minnesota's gun-grabbers aren't satisfied with the red flag law they forced through in 2023 — now they want to make it faster, longer, and cheaper to strip law-abiding citizens of their firearms without a criminal conviction.

Proposals moving through the St. Paul Capitol would extend Extreme Risk Protection Orders from one year to five years, allow judges to authorize emergency gun confiscations around the clock including weekends, and — pay close attention — eliminate the requirement that police reimburse you fair market value for the firearms they seize.

Read that again. Under current law, if the state takes your guns, they at least have to pay you back. These legislators want to strip even that minimal protection away.

They're also expanding who can file a petition against you. Under the proposed changes, any individual law enforcement officer on scene — not just chiefs or sheriffs — can initiate the ERPO process on the spot. One patrol officer can start the clock on stripping your Second Amendment rights before you face a single criminal charge.

Rep. Cedrick Frazier, DFL-New Hope, calls the expansion legislation that "has saved many lives." That's standard PR cover. What he won't tell you: 96% of petitions filed were granted. Judges rubber-stamp these orders at a near-automatic rate — that is not the rigorous judicial scrutiny due process demands.

The NRA sees it clearly. In a letter to a Senate committee, the organization correctly labeled this what it is: a "gun confiscation" scheme. The original 2023 law passed with zero Republican support, with opponents rightly warning it trampled due process. Now, in a tied Minnesota House, the bill cleared committee anyway — which means at least some Republicans went wobbly. Gun owners need to know who those members are.

The petition rate more than doubled — from 138 in 2024 to 314 in 2025. Advocates celebrate that number. Gun owners should recognize it for what it is: a system being weaponized at an accelerating pace against people convicted of nothing.

So-called red flag laws do not target criminals. Criminals don't register their guns, don't comply with court orders, and don't show up to surrender their weapons. These laws target you — the law-abiding gun owner whose neighbor, ex-partner, or a responding officer decides you're a "risk."

**Act now:** Contact your Minnesota state representative and senator. Demand a NO vote on any ERPO expansion. Find your legislator at leg.mn.gov. The NRA-ILA is tracking this bill — get on their action alert list at nraila.org. Don't let this state turn a bad law into a permanent, cost-free gun confiscation machine.
