Minnesota Democrats are doubling down on gun confiscation, pushing legislation that would turbocharge the state's two-year-old red flag law — stripping law-abiding gun owners of their firearms for up to five years without a single charge ever being filed.

The proposed changes would extend Extreme Risk Protection Orders from one year to five, allow any rank-and-file officer — not just chiefs or sheriffs — to file a petition on the spot, and require judges to consider emergency confiscation orders after hours and on weekends. Due process doesn't clock out at 5 p.m., but Minnesota Democrats want gun confiscation running around the clock.

The NRA delivered a letter directly to a state Senate committee, blasting the proposal as a "gun confiscation" scheme that strips citizens of constitutional rights before any crime is committed. They're right.

Here's the number every Minnesota gun owner needs to see: judges granted 96% of ERPO petitions in the first year. That's not a safety net — that's a rubber stamp. When courts reject only 4% of requests to strip Americans of a fundamental constitutional right, the system isn't protecting due process — it's bulldozing it.

Rep. Cedrick Frazier, DFL-New Hope, called the bill "legislation that has saved many lives." What he won't tell you is how many innocent gun owners had their firearms seized on nothing more than an accusation, with zero criminal charges ever filed.

The bill also quietly removes a provision requiring law enforcement to reimburse gun owners fair market value for surrendered firearms. The state can take your guns — and now they don't have to pay for the privilege.

More alarming: the measure advanced through the tied Minnesota House, meaning at least some Republicans crossed the aisle to move it forward. Those Republicans need to hear from their constituents — loudly and immediately.
