Enforcing Red Flag Orders Now a Felony in South Carolina
A growing wave of GOP states is criminalizing warrantless gun confiscation — and officials who comply face charges
South Carolina has drawn a hard line: enforce a red flag order against a law-abiding gun owner, and you face felony charges.
The Palmetto State's Ban Against Red Flag Gun Confiscation Act anchors a broader pushback sweeping Republican-led states — Montana, Oklahoma, Tennessee, Wyoming, and Texas among them. These legislators are done waiting for federal courts to rein in a system that strips citizens of their firearms before they've been convicted — or even charged — with any crime.
Red flag laws, formally called Extreme Risk Protection Orders (ERPOs), let courts seize your guns based on a complaint from a family member, coworker, or law enforcement — without you ever facing a judge first. That's not due process. That's a mechanism designed to gut the Second Amendment one gun owner at a time.
The anti-gun left sold ERPOs as a bipartisan mental health compromise. That fiction is dead. Gun rights advocates have spent years documenting the abuse: innocent people disarmed, no criminal charges filed, firearms seized and never returned. The "public safety" framing was always a Trojan horse.
South Carolina's bill sends an unambiguous message — officials who carry out these unconstitutional orders face real consequences. When the federal government won't protect your rights, states have both the authority and the obligation to step in.
The NRA and state-level gun rights groups have backed similar measures nationwide, and momentum is building. What started as scattered resistance has become a coordinated constitutional counteroffensive.
The Second Amendment has no asterisk. No bureaucrat, no activist judge, and no neighbor with a grudge gets to decide you've forfeited your right to keep and bear arms — not without due process.
If ERPO ban legislation is moving in your state, contact your representative now and demand they push it across the finish line. Find your legislator at openstates.org and make your voice heard before the gun-control lobby floods their inboxes first.
