5 Years. No Charges. No Jury. Minnesota's New Gun Grab Plan.

DFL lawmakers want ERPOs stretched to five years, same-night seizures, and zero compensation—no crime required, ever.

The 2023 red-flag law wasn't enough. Not even close.

DFL lawmakers are pushing a package in St. Paul that would supercharge Minnesota's Extreme Risk Protection Order system in three terrifying directions at once: longer orders, faster seizures, and zero financial accountability when they take your guns.

**No charges. No conviction. No jury. Five years.**

Under current law, ERPOs max out at one year. This bill extends them to five years in certain circumstances. That's half a decade of being legally disarmed—while you've never been accused of a crime, let alone found guilty of one.

And they don't want to wait until morning to come for your firearms.

The legislation mandates that judges hear emergency petitions after hours and on weekends. Any officer at the scene—not just department heads—could file the paperwork on the spot and push it to a judge that same night. Your front door at 10 p.m. is now a lawful entry point for same-night disarmament.

Then there's the provision they quietly buried in the press release.

Current Minnesota law requires police to reimburse gun owners **fair market value** for surrendered firearms. This bill eliminates that requirement entirely. They want to seize your legally owned property and owe you absolutely nothing in return.

The NRA put it plainly in a letter submitted to a Senate committee last week: this is a "gun confiscation" scheme. Hard to argue when the numbers tell the story themselves—96 percent of petitions get granted, and law enforcement files the overwhelming majority of them. This is not a careful, individualized judicial safeguard. It is an assembly line.

And the assembly line is accelerating.

138 petitions in the first year (2024). 314 in 2025. Already 60 in the first two months of 2026. Supporters are crowing that the surge proves it's "working." What they mean is that it is spreading—faster every year, with fewer brakes on it than ever.

Rep. Cedrick Frazier (DFL-New Hope) is carrying the House version. The DFL-controlled Senate has already moved a companion bill through committee.

Here is the detail that should make every Minnesota gun owner's blood run cold: the House version cleared committee in what CBS is calling a "bipartisan" vote—meaning at least some Republicans crossed over to advance it.

The NRA is already on record in opposition. Your state gun-rights organizations need your calls, your emails, and your physical presence in St. Paul—not next week, right now—before a five-year no-conviction confiscation order becomes the permanent new normal in Minnesota.

No charges. No conviction. Five years. No compensation.

That is not a public safety measure. That is a blueprint—and if it passes in Minnesota, you can bet the next statehouse to copy it is already watching.
