5-Year Gun Ban. No Charges. They Keep Your Guns AND Your Money.

Minnesota's new ERPO bill strips your rights for half a decade, lets cops file on the spot, and guts reimbursement—all without a single conviction.

No arrest. No charges. No conviction. Just a petition—and under the bill DFL lawmakers are advancing this session, that petition can cost you your firearms for **five years**.

That's not a typo. Five years of stripped Second Amendment rights for someone the state has never once proven guilty of anything.

Minnesota passed its original ERPO law in 2023, back when Democrats controlled every lever of the Capitol. Under that law, family members, attorneys, and law enforcement chiefs can petition a judge to seize a Minnesotan's guns for up to one year. Judges approve those petitions 96% of the time. The process moves fast. Rights disappear faster.

Apparently, that wasn't enough.

The new bill—carried in the House by Rep. Cedrick Frazier (DFL-New Hope)—extends the maximum order from one year to five. It mandates that judges be reachable after hours and on weekends to sign emergency confiscation orders. And it blows open the list of who can file: not just chiefs or sheriffs anymore, but any individual officer on scene. Respond to a domestic call. Decide you don't like the vibe. File a petition on the spot.

**That's not a safety net. That's a trapdoor.**

But here's the provision that should make every Minnesota gun owner's blood run cold: the bill eliminates the requirement that law enforcement reimburse owners fair market value for firearms surrendered under an ERPO. Right now, the state takes your guns—and pays you back. Under this bill? They keep the guns. They keep the money. You get nothing.

The NRA put it on the record in a letter submitted directly to a Minnesota Senate committee last week, calling it exactly what it is: a gun confiscation scheme. Lawmakers heard that letter read into the record. They kept moving anyway.

Frazier calls it life-saving legislation. What he won't say out loud: this bill punishes people who face zero criminal charges, strips rights before any meaningful due process hearing, and now proposes to hold those rights hostage for half a decade while you try to prove you deserve them back.

The bill has already cleared a key House committee—with bipartisan support, which means at least some Republicans handed Democrats the votes to advance it. The DFL-controlled Senate panel moved its companion bill the same week.

**The window to stop this is narrow and closing fast.**

This isn't a slippery slope argument. The slope already slipped. They started with one year, no charges, 96% approval. Now they want five years, weekend raids, any cop with a pen, and no compensation for what they take. Every single expansion builds on the last. If this passes, the next version will be worse—and they'll point to this one as proof it works.

Minnesota gun owners need to melt the phone lines at the Capitol before this hits the floor. Find your state representative and senator at **leg.mn.gov**. Call. Show up. Make noise.

A five-year gun ban without a conviction is not a public safety measure. **It is a punishment—handed down by people who were never required to prove you did anything wrong.**

Watch this one. Because if Minnesota locks this in, your state is next.
