Federal appeals courts don't send cases back down because everything is fine. They send them back when something went wrong—and that's exactly what happened here.

The Tenth Circuit ruled that Second Amendment plaintiffs have standing to challenge Colorado's prohibition on possessing unserialized firearms, then punted the injunctive relief question back to the district court with a clear message: look harder. That's not a loss. That's a second shot at an enforcement block the district court never should have denied in the first place.

**The move that matters most:** the panel surgically separated Colorado's state ban from the ATF's ghost gun rule. The Supreme Court letting the ATF rule stand doesn't save Colorado's law—because a federal agency regulation and a state legislative ban are two different animals, subject to two different fights. Plaintiffs can still attack the state law directly on its merits, and now they get to.

The district court had shut down the injunction request. The Tenth Circuit rejected that shut-down. An active court order blocking enforcement of the ban remains on the table—not hypothetically, not eventually. Right now.

This is the blueprint anti-gun legislators hate most: not one big knockout swing, but round after round, jurisdiction by jurisdiction, forcing them to defend every inch of unconstitutional ground they've seized. **Passing a law is not the same as keeping it.** Colorado is about to learn that lesson again.
