10th Circuit Blindsides Colorado: Ghost Gun Ban Sent Back
Federal appeals court says district court blew the injunction call — Colorado's possession ban is suddenly on life support.
The Tenth Circuit ruled that 2A challengers have standing to contest Colorado's prohibition on possessing unserialized firearms — a procedural door that most observers assumed had been welded shut forever.
It wasn't.
More critically, the appellate panel found the district court made a straight-up error when it denied injunctive relief on the possession ban. That ruling goes back down for reconsideration — which means enforcement of that provision could be blocked while the constitutional fight plays out.

Yes, the ATF's ghost gun rule survived at the Supreme Court. But the Tenth Circuit drew a bright line: a federal rule surviving SCOTUS does not give a state law automatic immunity from its own constitutional reckoning. Colorado Democrats have spent years layering gun restriction on top of gun restriction, betting that sheer volume creates permanence. This ruling is a direct challenge to that strategy. The court didn't strike the whole law — but it forced a hard second look at one of its most aggressive provisions: a blanket ban on simply *possessing* an unserialized firearm, no matter how it was made, no matter when it was obtained.
Possession. Of a firearm. That you may have legally owned before this law existed.

This is not a final win. The lower court could still deny relief. But the playbook has changed. Injunctive relief is back on the table, the appellate panel has signaled the lower court got it wrong, and Colorado's gun-control architects just lost a round they had already started celebrating.
