Trump's DOJ Is Arguing Against You in Court
Pro-gun press releases up top, anti-Bruen retreat underneath—and activist judges are already taking notes.
Acting AG Todd Blanche's DOJ deserves credit where it's real: some of those filings have genuinely advanced Second Amendment interests. Credit given. Now here's the problem that doesn't make the press release.
The same DOJ is retreating from *Bruen* arguments in other federal cases—and in constitutional litigation, inconsistency is not a minor procedural hiccup. **It is a gift to every activist judge waiting for daylight.**
Here is the mechanics of the damage: when the federal government takes contradictory legal positions across circuits, it manufactures circuit splits, muddies the precedent trail, and gives hostile courts the exact cover they need to rule against the Second Amendment. You don't have to beat gun owners in one big case when you can bleed the doctrine out across fifty small ones.
Gun rights organizations including GOA and FPC have already flagged this pattern. They see what's happening. When the United States government itself won't hold a clean legal line on *Bruen* and its progeny, every future 2A case becomes harder—not easier—to win. Activist judges don't need a wide-open door. They just need a crack. The DOJ keeps providing it.
**A fair-weather ally in a constitutional firefight is worse than no ally at all.** It signals to the courts that even the administration has reservations about the precedent it's supposed to be defending.
Trump signed executive orders. He made promises to gun owners. Those promises do not carry an asterisk that reads *unless the litigation gets complicated*.
Do not let the pro-gun headlines lull you into assuming the administration has your back in every courtroom that counts. The press releases are for you. The filings are for the judges. Those are two different documents, and right now they are not saying the same thing.
Watch the filings. Demand that GOA, FPC, and NRA-ILA publicly pressure the DOJ to maintain consistent, *Bruen*-faithful arguments across every case—no exceptions, no quiet carve-outs, no managed retreats.
**The Second Amendment doesn't get a day off. Neither should the people sworn to defend it.** Keep pressure on. The next ruling that chips away at *Bruen* may trace its permission slip straight back to a DOJ brief nobody was watching.
