They Can Take Your Guns Before You Know It's Happening

No crime. No arrest. No courtroom appearance. In 21+ states, one phone call from a coworker or ex can disarm you overnight.

In more than 20 states, Extreme Risk Protection Orders — ERPOs — let a judge hear one side of a story, sign a piece of paper, and send law enforcement to your door. You are not in that courtroom. You are not notified in advance. The first sign something happened is often a knock you weren't expecting.

**That is not a hypothetical. That is the law in your state right now.**

ERPOs can be filed by family members, household members, and — depending on where you live — medical professionals, employers, coworkers, and school administrators. California allows the person you share a cubicle with to initiate the process. Illinois added school officials to the list. The expansion moves in exactly one direction: more people who can file, never fewer.

The legal threshold? It varies wildly. Some states require "credible threat" evidence. Others require only that the petitioner *believes* you pose a risk. Not a crime. Not an arrest record. Not a single documented incident. A belief — and your rights evaporate.

The order is granted ex parte. One side speaks. The judge rules. Law enforcement arrives.

**Guilty until proven innocent, enforced with a badge and a moving truck.**

Once your firearms are seized, you have roughly 14 to 21 days to challenge the order — in theory. In states with backlogged courts, that hearing drifts. Your property sits in an evidence room while the calendar moves at the government's pace. There is no federal standard defining "danger." There is no national ERPO database. There is no mandatory legal representation for you, the respondent.

You are on your own, on a shrinking clock, against a system engineered to move fast and sort out accuracy later.

The resistance, where it exists, is real — and it is the model every state should be chasing. Six states have not only refused to implement ERPOs but have criminalized local enforcement of out-of-state orders. That is the floor. Not the ceiling.

If you live in an ERPO state, you need three things before this week is out: the name of a 2A-friendly attorney in your county, a written record of any relationship that could generate a bad-faith petition, and your state legislators' direct contact information — because these laws did not get worse on their own.

**The people who built this system are counting on you not knowing how it works until it's too late.**

Find your state's ERPO statute. Read it. Then send this to every gun owner you know — because the next knock could be on their door, and they deserve to see it coming.
