SCOTUS Punts Again: What Every Gun Owner Must Do Now

The Supreme Court ducked two major Second Amendment cases — lower courts keep their anti-gun rulings, and the fight falls back to you.

The high court refused to grant certiorari on two of the most closely watched Second Amendment cases of the term. That refusal doesn't kill these fights — but it lets activist judges in blue circuits keep their unconstitutional precedents on the books, enforceable and dangerous, until litigators come back with a cleaner case.

When SCOTUS declines to hear a case, lower court rulings stand. Whatever anti-gun precedent those circuits baked in stays in force. That's not a small thing.

Here's the strategic reality: gun-rights litigators at organizations like the Second Amendment Foundation and Firearms Policy Coalition don't quit — they reload. They'll sharpen the legal arguments, find better plaintiffs, and build tighter records designed to force the Court's hand the next time around.

Meanwhile, Acting AG Todd Blanche and the DOJ need to get off the sidelines. The DOJ already walked back its position on the frame and receiver rule — good. But reversing bad policy isn't enough. Biden-era legal wreckage still litters the federal courts, and the Trump DOJ has both the authority and the obligation to actively argue for Second Amendment rights in every pending case.

States aren't waiting for SCOTUS to act — they're pushing new restrictions right now. California continues making concealed carry permits nearly impossible to obtain. Virginia's governor is pushing a firearms ban amendment. These battles are happening today, regardless of what nine justices in Washington decide to skip.

The Bruen decision in 2022 gave gun owners a powerful constitutional weapon — the historical tradition test. But Bruen only works if courts apply it honestly, and lower court judges in blue circuits have spent three years twisting it into pretzels. SCOTUS refusing these cases lets that evasion continue.

This is not the time to get discouraged. It's the time to get organized.

Support the legal groups fighting in court. Know your state legislators by name. Show up. The Second Amendment doesn't defend itself — that's your job.
