SCOTUS Had 18 Chances to Defend Your Rights—Blew Every One
Justices even granted cert on a petition with 2A questions—then surgically cut those questions out before doing it.
At its April 24 conference, the Supreme Court had 18 separate cert petitions touching the Second Amendment sitting on the table. Eighteen chances to rein in rogue lower courts. The justices found a reason to duck every single one.
That alone would be damning. But the *how* makes it worse.
One petition came in carrying three questions—two of them squarely about the Second Amendment. The Court granted cert on that petition, then performed a surgical strike: carved out the lone non-2A question, left the two Second Amendment issues dead on the floor, and moved on. **That is not an oversight. That is a choice.**
Since *Bruen* (2022) rewrote the rules and *Rahimi* followed last term, lower courts have been running a masterclass in obstruction. The Ninth Circuit. The Fourth Circuit. Anti-gun state AGs from California to Maryland. They've upheld carry restrictions, magazine bans, and firearm prohibitions—twisting the historical-tradition test into whatever shape gets them to the answer they want. Gun owners have flooded the appellate pipeline betting SCOTUS would finally crack the whip.
The Court keeps finding reasons to look the other way.
**Eighteen petitions. Eighteen green lights handed to every anti-gun jurisdiction in America.**
The message radiating out of One First Street right now is simple, and lower courts are already reading it: stall, obstruct, invent exceptions—nobody's coming to correct you. Anti-gun AGs and legislatures will treat that silence exactly like what it is: permission to keep tightening the screws heading into the next election cycle.
This is how rights die—not in one dramatic ruling, but in a thousand conference-room pass votes that never make the news.
The remaining petitions are still alive—for now. If the Court continues to deny or GVR without clear guidance, the lower-court circus runs indefinitely, and every win at the appellate level becomes a one-circuit fix that means nothing two states over.
**Watch the pending docket like a hawk.** Support the legal organizations—FPC, SAF, GOA—grinding through the lower courts right now, because SCOTUS clearly isn't riding to the rescue on its own timetable. And pressure your senators to ask every single judicial nominee the only question that matters: *Do you believe* Bruen *is settled law?*
The Court will have to take a 2A case eventually. The question is how much damage gets done while they wait—and whether there's anything left to defend when they finally show up.
