SCOTUS Had 18 Chances to Defend the 2A — Took Zero
Justices granted one petition, then surgically cut both Second Amendment questions out of it. That's not an accident.
Not one. Not a nibble. Eighteen petitions, eighteen rejections — and the one case they *did* take, they immediately gutted.
Here's how that worked: one of the 18 petitions carried three questions, two of them directly implicating the Second Amendment. SCOTUS granted cert on that petition — then carved both 2A questions out and kept only the unrelated third issue. **They picked the bones clean and left gun owners with nothing.**
That is not a coincidence. That is a strategy.
The Court has perfected the art of granting cert on everything *around* the Second Amendment while refusing to touch the amendment itself. Seventeen petitions got outright denied. One got cherry-picked to death. The message to lower courts couldn't be louder if it came with a megaphone: keep doing what you're doing.
And lower courts have been doing exactly that — upholding restrictions that would've been laughed out of any honest *Bruen* analysis, knowing SCOTUS will not ride to the rescue. *Bruen* was supposed to be the watershed. Instead, it's become a test the justices seem allergic to enforcing.
**This is the post-*Bruen* reality nobody says out loud.** The framework exists. The precedent is there. And the Court keeps manufacturing reasons to let it collect dust while Americans lose rights in circuit after circuit.
Watch the remaining petitions on the docket. Watch whether the Court reschedules any for re-conference — that's sometimes the last signal before a grant or a final burial. And watch your state legislature, because the cold truth is this: if nine justices in Washington won't act, the fight lives or dies at home.
