Rule Is Dead. ATF Still Calling Your Brace an SBR.
Courts vacated the brace rule—ATF ditched the regulation and kept the weapon: a raw statutory argument that needs no rule to ruin your life.
The rule is gone. Vacated. Dead in court. ATF lost, gun owners won—except the agency never actually surrendered.
Here's what they did instead: strip the formal regulation, then quietly maintain that certain braced pistols are still short-barreled rifles under the NFA's own statutory language. No rule required. No rulemaking process. No public comment period. Just the ATF's interpretation of the words "designed or redesigned"—and the full weight of federal felony charges behind it.
**They don't need the rule if they can weaponize the statute.**
This is the part that should make every gun owner's blood run cold. ATF spent years issuing approval letters for brace designs. It built an entire product category on those approvals. Tens of millions of law-abiding Americans bought braced pistols in good faith—with the agency's own blessing on record. Then the Biden administration reversed course and tried to turn those same gun owners into overnight felons. Courts said no. Now ATF is trying to salvage what it can through informal enforcement posture, one firearm at a time.
This is not an accident. This is a strategy.
Litigation is still active. That means the legal fog has not lifted. Any owner with a braced pistol who thinks the court victories mean they're fully in the clear is operating on hope, not confirmed law. ATF's post-rule position on individual firearms remains deliberately murky—and murky is dangerous when the downside is a federal felony.
**Killing the rule was round one. Round two is already underway.**
Gun rights organizations cannot declare victory and walk off the field. The next required move is forcing ATF to issue clear, binding guidance: braced pistols approved under prior agency determinations are not SBRs, full stop. Anything less leaves law-abiding owners dangling in legal limbo—one administration change away from the whole nightmare starting over.
Call your representatives. Support the legal organizations still in the fight. Demand that Acting AG Todd Blanche put ATF on a short leash before this enforcement window quietly widens.
Don't put your brace back on and call it a win. The agency lost the battle in court—and immediately opened a second front. Watch this space.
