Red Flag Laws Let Courts Seize Your Guns Without a Crime

That's not a hypothetical. It's the reality of so-called 'red flag' laws, formally known as Emergency Risk Protection Orders (ERPOs), now active across a growing number of states.
Here's how it works: a family member, law enforcement officer, or in some states even a medical professional files a petition claiming you're a danger to yourself or others. A judge reviews the request — often without you present — and signs an order directing law enforcement to show up at your door and confiscate your legally owned firearms.
Read that again. No criminal charge. No conviction. No due process before the taking.
Proponents call these laws life-saving tools. What they actually are is a constitutional end-run around the Second, Fourth, and Fourteenth Amendments simultaneously. You lose your property first. You fight to get it back second — at your own expense, in a court that already ruled against you.
The petition process varies by state. Some require law enforcement to initiate the order. Others — including California, Colorado, and New York — allow family members or household members to file directly. Illinois and a handful of others extend that power to medical professionals, meaning your own doctor could trigger a firearms seizure.
Hearing timelines differ too. Most states allow a temporary ex parte order — issued without your knowledge or participation — lasting anywhere from 7 to 21 days. A follow-up hearing then determines whether the order extends, sometimes for up to a year.
The burden falls on you to prove you're not dangerous. That's a deliberate inversion of how American justice is supposed to work.
Defenders of ERPOs point to suicide prevention as the primary justification. But stripping a person of their constitutional rights based on an accusation — with no criminal standard of proof required — sets a precedent that should alarm every law-abiding gun owner in America.
Federal momentum has only accelerated the spread. The Bipartisan Safer Communities Act of 2022, signed by Biden, funneled millions in grant money to states to create or expand red flag programs. Anti-gun legislators in Washington used your tax dollars to push these laws further.
Acting AG Todd Blanche has not moved to challenge ERPO frameworks at the federal level. Gun owners should demand he does.
