That's the cold reality of Emergency Risk Protection Orders — red flag laws — now active in more than 20 states.

Under these laws, law enforcement, family members, and in some states even medical professionals can petition a court to strip your Second Amendment rights. A judge signs off, police show up at your door — no criminal charge, no conviction, no due process.

Call it what it is: prior restraint on a constitutional right. You are presumed dangerous until you prove otherwise, and your property gets seized in the meantime.

The burden then falls on you — the law-abiding gun owner — to fight in court to reclaim your own firearms. Legal fees. Court dates. Time off work. All because someone filed a petition claiming they were worried about you.

ERPOs deliberately bypass the protections built into the criminal justice system. No requirement that you threatened anyone. No requirement that a crime occurred. Just an accusation and a rubber-stamp hearing — often without you present.

Proponents claim ERPOs save lives. What they won't tell you: these orders get abused — by angry ex-partners, estranged family members, and overzealous medical providers who become weapons for stripping innocent Americans of their rights.

California, New York, and Illinois carry the broadest red flag statutes — and the longest lists of who can file against you. Anti-gun lawmakers in those states have made no secret of their goal: maximum barriers between law-abiding citizens and their firearms.

Acting AG Todd Blanche and the Justice Department have mounted no serious federal challenge to ERPO frameworks that conflict directly with the Bruen standard the Supreme Court set in 2022. That silence speaks volumes.

Bruen requires that any firearms restriction be rooted in America's historical tradition of gun regulation. Pre-crime confiscation orders have no such tradition — and 2A attorneys are already building the cases to prove it.

Know your state's laws today. Line up a 2A-friendly attorney before you need one. Contact your state legislators and demand repeal or reform of every ERPO statute on the books. Your rights don't pause because someone filed paperwork.
