Pistol Braces Are Legal — Know Your Rights in 2025
Federal courts killed the ATF's brace ban. Here's what every gun owner needs to know right now.
Pistol braces are fully legal accessories under federal law in 2025, after federal courts gutted the ATF's overreaching Final Rule 2021R-08F. That rule would have forced owners of pistol-braced firearms to register, tax-stamp, or destroy their legally purchased property. Courts saw through it.
Here's the bottom line: a pistol brace does NOT reclassify your pistol as a short-barreled rifle. An SBR requires a $200 NFA tax stamp, federal registration, and ATF approval. A legally configured pistol with a brace requires none of that.
The distinction matters. A bare buffer tube on an AR-style pistol is a functional component — not a stock. A properly designed pistol brace, intended to stabilize the firearm against a shooter's forearm, keeps your pistol classified as a pistol. Period.
The ATF spent years trying to blur that line. Under the Biden administration, the agency rewrote definitions, invented arbitrary point systems, and declared that how you shoulder a brace determined your federal felony status. That is not law enforcement — that is bureaucratic tyranny.
Acting AG Todd Blanche's DOJ inherited this mess. Gun owners are watching closely to see whether the department permanently abandons the ATF's war on brace owners or quietly resurrects it through new rulemaking.
State law is a separate fight. Several anti-gun states have moved to impose their own restrictions on pistol-braced firearms. Know your state's laws before you build, buy, or transport.
The bottom line: your pistol brace is legal, the ATF's power grab failed, and the Second Amendment held the line — this time.
