NSSF to Dealers: The NFA Win Is Live — But the Compliance Map Is a Minefield
Suppressors have the clearest path. SBRs, SBSs, interstate movement, state law, SOT rules, Form 4473 and NICS still create traps.

NSSF published dealer guidance August 17, 2026 on Silencer Shop v. ATF. The industry trade group’s warning is operational: the injunction is live because DOJ skipped an emergency stay, but coverage depends on whether the dealer, buyer, organization, or customer falls inside the order. Named plaintiffs include Silencer Shop Foundation, GOA, Palmetto State Armory, SilencerCo, FRAC, 15 states, and the Jensen-side groups (Texas State Rifle Association, CCRKBA, FPC Action Foundation, Hot Shots Custom). State plaintiffs cover agencies — not every resident of those states.
The Gun Control Act was not enjoined. Form 4473, NICS, marking, and recordkeeping remain. NSSF flags 18 U.S.C. § 922(b)(4) as the SBR/SBS trap: NFA paperwork was the “authorization” ATF used for dealer transfers of short-barreled rifles and shotguns, and ATF has not supplied a replacement. Interstate movement and re-importation under 26 U.S.C. § 5861(j)–(k), SOT taxes, NFRTR off-books, and state laws that still require NFA registration all remain unresolved.
NSSF says suppressor transfers by covered entities appear to present the clearest route, and it is asking ATF for formal guidance. Until that arrives, dealers need counsel — not social-media certainty.
