Minnesota's Red Flag Law Just Got 5x More Dangerous

A midnight filing, a rubber-stamp judge, and you wake up Sunday with no guns—and zero reimbursement. Some Republicans are helping make it happen.

That is not paranoia. That is the exact mechanism Democrats in St. Paul are voting to install right now—and they've got the police lobby cheering them on.

The bill isn't a tweak. It's a demolition of the already-thin guardrails on Minnesota's Extreme Risk Protection Order law. Lawmakers want to stretch ERPOs from one year to **five years**, let any individual patrol officer—not just chiefs or sheriffs—file a petition on the spot, rip out the requirement that police reimburse gun owners fair market value for seized firearms, and force judges to consider emergency confiscation orders after hours and on weekends.

**You can lose your Second Amendment rights before you even know a petition exists.**

And don't think the courts are protecting you. In year one, Minnesota judges approved 96 percent of ERPO petitions. That's not a check on the system. That's a rubber stamp with a robe on it.

The numbers make the trend impossible to ignore. Minnesota saw 138 ERPO petitions in 2024. That exploded to 314 in 2025—more than double. And 60 more were already filed in just the first two months of 2026. Richfield Police Chief Jay Henthorne, president of the Minnesota Chiefs of Police Association, went on CBS Minnesota and called that surge "successful."

Successful at stripping due process from Minnesotans at record pace, sure.

Rep. Cedrick Frazier, DFL-New Hope, is carrying the bill in the House and dressing it in life-saving language. What he won't say: his bill kills the financial penalty on government for seizing your private property. That reimbursement requirement was one of the only structural costs built into the law to make frivolous filings hurt. **Democrats want that deterrent dead.**

The NRA sent a letter to a Minnesota Senate committee last week calling it exactly what it is: a **"gun confiscation" law.** The sequence is simple—accusation, judicial rubber stamp, seizure. You are presumed guilty. The burden is on you to prove otherwise, potentially for five years.

Here's what should chill every gun owner reading this: the bill has drawn **bipartisan support** in the tied Minnesota House. Some Republicans are voting yes. That is how confiscation laws survive elections—they get normalized, expanded, and eventually become untouchable. This is how you lose ground you never get back.

Minnesota gun owners, the window is closing. The NRA is already on record in opposition, but lobbying letters don't vote—you do. Find your state House and Senate representatives at leg.mn.gov and make the call before this hits a full floor vote.

Because once this passes, the next expansion won't need bipartisan cover. It'll just need precedent—and this bill hands them exactly that.
