Minnesota: 5-Year Gun Ban—Any Cop, No Court, No Warning
A rookie officer at your door could strip your 2A rights for five years before you ever speak to a judge—and now they want to do it 24/7.
Minnesota Democrats rammed through a red-flag law in 2023. Now they want to supercharge it—and they're calling it a "fix."
Proposals moving through both chambers would extend Extreme Risk Protection Orders from one year to **five years**, allow judges to issue emergency seizure orders around the clock on weekends and holidays, and blow the doors open so that *any* patrol officer—not a chief, not a sheriff, any officer—can file a petition on the spot and take your firearms before you've had one day in court.
**Half a decade. Before you say a word in your own defense.**
Here's the number the gun-control crowd is crowing about: in 2025, judges granted **96% of ERPO petitions**—314 filed, nearly all approved. What they won't tell you is why that rubber-stamp rate should terrify you. These are ex parte proceedings. The gun owner isn't in the room. There is no other side of the story. A judge signs, and your rights vanish.
That's not due process. That's a formality with a gavel.
The bill goes further. It kills a reimbursement provision that required law enforcement to pay fair market value for surrendered firearms. The state takes your guns—legally mandated compensation gone. They owe you nothing. Your property, their trophy.
Rep. Cedrick Frazier, DFL-New Hope, is carrying the House bill. He calls the original law "legislation that has saved many lives." Zero verifiable proof offered. Just a talking point wearing a body count.
The NRA isn't buying it. In a letter submitted directly to a Senate committee, the NRA put it in writing: this is a **"gun confiscation" scheme** that violates due process and fails the very people it claims to protect. That opposition is on the record—permanent and public.
Here's what should make your blood run cold: the House measure cleared committee with bipartisan support in the tied chamber. That means Republicans helped it move. **Names matter. Find yours. Hold them accountable.**
The DFL-controlled Senate pushed its companion bill through committee last week. Both chambers are moving fast and in sync.
**This is the part where you either act or watch it happen.**
Contact your Minnesota state representative and senator today—not after the weekend, not when it's convenient. Tell them a five-year firearm prohibition that any officer can trigger on any day of the week is an unconstitutional assault on the Second and Fourteenth Amendments. The NRA has drawn the line in writing.
Minnesota gun owners need to show up and hold it—because the other side already is.
