Here's what the gun-grabbing media won't tell you: after Bruen in 2022 dropped like a constitutional bomb, SCOTUS vacated and remanded a massive pile of lower court rulings and told judges to try again. After Rahimi in 2024, they did it again. That means dozens of cases — covering everything from carry permits to pistol braces to felon-in-possession laws — are being relitigated RIGHT NOW in courts that spent years rubber-stamping every restriction Newsom, Hochul, Pritzker, and Murphy could dream up.
The 2008 Heller decision confirmed the Second Amendment protects an individual right — and then the lower courts spent more than a decade quietly strangling it with 'means-end' balancing tests that let any judge approve any gun law if they squinted hard enough. Bruen killed that game. Justice Thomas, writing for the majority, said the only test that matters is whether a gun law is rooted in America's historical tradition of firearm regulation. Anti-gun judges HATE this standard because it actually requires them to justify restrictions with history — not vibes.
So where does that leave us? Scattered. Inconsistent. And dangerously dependent on which circuit you live in. The Ninth Circuit — home to California, Oregon, and Washington — is still fighting the historical test tooth and nail. Meanwhile, other circuits are striking down mag bans, suppressor restrictions, and carry prohibitions. That patchwork is exactly the kind of circuit split that forces SCOTUS to step back in — and when it does, the ruling will apply to all 330 million Americans, not just the ones lucky enough to live in a free state.
The cases to watch are already in the pipeline. Ghost gun rules, pistol brace regulations, the bump stock ban fallout, age-based purchase restrictions — every one of these is working its way up. Todd Blanche's DOJ has a chance to drop or modify several Biden-era arguments that propped up unconstitutional ATF overreach. Kash Patel's FBI could stop weaponizing the NICS background check system against veterans and legal gun owners. The wins are possible. But they require pressure, attention, and gun owners who refuse to look away.
