Florida HOA Banned Carry — Cops Laughed and Walked Away

A condo board tried to out-legislate Florida's preemption law. Local police delivered a one-word answer: no.

A homeowners association in Florida decided its board meeting gavels carried more weight than state law. They banned concealed carry in community parks and common areas, apparently under the impression that a quorum of volunteers can override the Florida Legislature.

Local police corrected that misunderstanding immediately — by refusing to enforce a single word of it.

**Because here's the thing the board didn't want to say out loud:** HOA rules are private contracts. Not statutes. Not ordinances. Not law. Police enforce laws — not the board president's color-coded newsletter.

Florida is a shall-issue state with one of the strongest firearm preemption laws in the country. The rules on carrying a firearm belong to the state legislature — not your city, not your county, and absolutely not a committee of retirees who got dangerously comfortable with Robert's Rules of Order.

The HOA can write whatever it wants in its bylaws. What it cannot do is have you arrested for legally carrying in the community gazebo. The cops already confirmed that — in real time.

But don't spike the football yet.

HOAs carry civil teeth even when they can't use criminal ones. They can fine you, slap liens on your property, and drag you through arbitration that costs real money and real time. **The gun stays legal. Your wallet is a different story.**

If you live under an HOA, pull your CC&Rs right now and find the firearms language. If the board added anti-carry provisions after you closed on your home, document every word of it. Florida Carry has resources and attorneys who know this terrain cold — use them before the certified mail starts arriving.

The police did their job here by refusing to do the HOA's dirty work. That's a win. But it's round one, not the final bell.

Residents now have to push back through the HOA process, show up and vote in board elections, and be ready to litigate if this board decides to get expensive about it. The law is on your side — but the law doesn't attend the annual meeting for you.

**Your rights don't stop at the neighborhood gate.** Don't let a volunteer board with a laminator and too much free time convince you otherwise.

Watch this space — Florida HOAs testing preemption law is a pattern, not an isolated stunt. More boards are watching how far they can push. The answer needs to keep being: not this far.
