Clyde and Plaintiff-State AGs Press DOJ: Make the NFA Ruling Work Nationwide
Nearly 50 lawmakers want no appeal and permanent rulemaking. Oklahoma and eight other plaintiff-state AGs want ATF instructions for dealers now.

On August 11, 2026, Rep. Andrew Clyde (GA-09) led 46 House and Senate Republican cosigners in a letter to Attorney General Todd Blanche: decline any appeal of Hendrix’s Silencer Shop / Jensen ruling, apply it nationwide, and start APA rulemaking to rescind the challenged registration rules for untaxed firearms. Their operational point: identical transactions should not turn on whether a buyer is a Silencer Shop customer or a GOA member.
Oklahoma Attorney General Gentner Drummond — Oklahoma was a plaintiff — followed August 14 with a coalition letter from nine plaintiff-state AGs asking DOJ/ATF to say in writing how purchasers and dealers will know which registration requirements are enjoined. They want ATF website notice and direct notice to dealers and manufacturers in plaintiff states. Drummond: no law-abiding Oklahoman should have to be fingerprinted, photographed, and cleared by Washington to buy a suppressor to collect a tax that no longer exists.
The court created plaintiff-limited relief. Congress and the plaintiff states are now forcing DOJ to choose: clarify it, expand it, or fight it through October.
