Response time starts when someone calls. The threat starts when the door gives. In Chesnee those were not the same moment.
  • Spartanburg County Sheriff’s Office: ~2 a.m. Sunday, Cherokee Circle, Chesnee, S.C. Homeowner shot an intruder. Two residents uninjured.
  • Decedent identified as Xavier Felix Rivera-Goucher, 19, of Campobello. Deputies: no prior relationship with the household.
  • Lt. Graham McLellan (SCSO), to WYFF: no belief charges will be filed. Investigation still open.
  • WSPA independently reported the same Cherokee Circle call, 2 a.m. hour, and no charges filed.
  • South Carolina Castle Doctrine / Protection of Persons and Property Act: presumption of reasonable fear on unlawful, forcible entry of an occupied dwelling.

Spartanburg County Sheriff’s Office deputies responded to a reported shooting at a home on Cherokee Circle in Chesnee, South Carolina, at about 2 a.m. Sunday, WYFF reported. They found one person dead with multiple gunshot wounds. Two other people who lived at the home were there and uninjured. Investigators said 19-year-old Xavier Felix Rivera-Goucher of Campobello had gone into the home in the early morning. The homeowner encountered him and shot him. Deputies said no one in the house knew Rivera-Goucher.

Lt. Graham McLellan of the Spartanburg County Sheriff’s Office told WYFF on Monday morning: “It’s a scary situation for the family who had their home broken into, they have to live with the fear of that happening for the rest of their life as well as the weight of what transpired when they encountered that individual.” He added, “At this point, there is not a belief that charges will be filed.” The investigation remains open. WSPA, citing the Sheriff’s Office and the County Coroner’s Office, reported the same Cherokee Circle response, the same 2 a.m. hour, and that no charges had been filed.

South Carolina’s Protection of Persons and Property Act supplies the legal frame: an occupant is presumed to have a reasonable fear of imminent death or great bodily injury when someone unlawfully and forcibly enters an occupied dwelling. That is the statute. The operational fact is shorter. A 19-year-old stranger was inside a Chesnee house at 2 a.m. The people who lived there were armed. The deputies arrived after the shot. McLellan’s line is the charging picture as of September 1: they do not believe charges are coming.

"A stranger was in the house at 2 a.m. The homeowner did not wait for a deputy. The sheriff does not expect charges."
