Byrd Rule Kills Suppressor Deregulation — Fight Moves to Floor

NFA reform got blocked in reconciliation, but the Hearing Protection Act gives gun owners a clear path to victory.

Senate parliamentarians just killed the fastest route to suppressor deregulation in decades — now gun owners have to fight harder and smarter.

Legislators pushing to strip suppressors from the National Firearms Act hit a procedural wall: the Byrd Rule, which bars policy changes unrelated to the federal budget from riding inside reconciliation bills. The ruling blocked full NFA deregulation before it ever reached a floor vote.

That matters because reconciliation was the fastest lane available — a simple majority in the Senate, no filibuster, done. Now supporters must either find a procedural workaround or build the 60-vote coalition needed to pass a standalone bill through regular order.

This setback was engineered, not accidental. Anti-gun groups Everytown and Giffords lobbied hard against removal, pushing the tired lie that hearing-protection devices are tools of criminal violence. They are not. Suppressors reduce noise — full stop. Criminals don't fill out ATF paperwork, pay $200 tax stamps, and wait 12 months for approval. Law-abiding gun owners do.

Right now, those law-abiding Americans jump through extraordinary hoops — background checks, lengthy waits, federal registration, and a Depression-era tax — just to protect their hearing at the range. That's not regulation. That's harassment.

The Hearing Protection Act has circulated in Congress for years. It would move suppressors off the NFA entirely and treat them like any other firearm accessory — a straightforward Form 4473 at the point of sale. That's the bill gun owners need to demand their senators and representatives advance today.

Acting AG Todd Blanche and the Justice Department could also signal administrative openness to streamlining NFA processing in the interim — a step that costs nothing legislatively and delivers immediate relief to the 1.5 million Americans currently waiting on suppressor approvals.

The Byrd Rule blocked one route. Congress has others. Call your senators now and demand a standalone vote on the Hearing Protection Act — because your right to shoot without going deaf shouldn't cost $200 and a year of your life.
