ATF's Brace Rule Is Dead — The Threat Isn't

Agency killed its own rule but still claims millions of legally purchased braced pistols qualify as SBRs.

The ATF lost. The brace rule is dead. Now the agency is eyeing your legally purchased firearm and calling it a short-barreled rifle.

Let that sink in. The ATF spent years approving pistol braces, collected fees, rubber-stamped designs, and encouraged tens of millions of Americans to buy braced pistols. Then, under the Biden administration, the agency reversed overnight and declared those same firearms NFA-regulated SBRs — threatening gun owners with felony charges for possessing hardware the government itself greenlit.

Courts struck the rule down. Gun owners and Second Amendment organizations fought back hard, and they won. The brace rule is no longer in effect.

But here's where it gets dangerous: the ATF now signals that certain braced pistols may still meet the statutory definition of an SBR under existing law — independent of the dead rule. The agency is reserving the right to prosecute gun owners even without the rule courts just destroyed.
