ATF Won't Tell You Which Braced Pistols It's Prosecuting

GOA demanded a written list. ATF's answer: you'll find out when federal prosecutors read you the charges.

Let that land for a second.

The rule is gone. The threat is not.

GOA went directly to ATF and demanded one simple thing: a written list of which braced-pistol configurations the agency considers illegal under existing law. ATF's answer, per GOA, was essentially nothing — no list, no clarification, no warning. The first time millions of law-abiding gun owners may learn their firearm crossed some invisible line is when a federal prosecutor tells them so.

**That is not a regulatory gray area. That is a trap.**

Here's the mechanism: Biden's pistol-brace rule was struck down, but the underlying National Firearms Act and Gun Control Act statutes that predate it are still on the books. ATF is threading those older statutes through the corpse of the brace rule — continuing to target braced pistols it quietly deems to have crossed into Short-Barreled Rifle territory — without ever publishing where that legal line sits.

No rulemaking. No public comment period. No binding written guidance.

Just federal enforcement power aimed at Americans who bought a legal product, at a licensed dealer, in complete good faith — and who have no way of knowing today whether they are criminals in ATF's eyes.

GOA is demanding the agency produce explicit, written guidance that defines lawful configurations in plain language. ATF is stonewalling.

**If ATF could draw a clean line, it would. The deliberate silence is the answer — and gun owners are paying for it.**

This is regulatory ambiguity weaponized. An agency that cannot — or will not — tell you the rule has no business enforcing it. That is not how law works in a country with due process. It is, however, exactly how bureaucratic intimidation works: keep the definition fuzzy, keep gun owners nervous, keep compliance impossible to guarantee.

Do not assume you are safe because the Biden rule died. The underlying statutes are live, ATF's enforcement posture is live, and right now there is no written protection between your brace and a federal indictment.

Contact GOA. Contact your congressional representative. Demand ATF publish binding written guidance on exactly which configurations remain lawful — or get out of the braced-pistol enforcement business entirely.

Watch this space. GOA's pressure campaign on ATF is not over, and Congress is watching. The next move from the agency — or the silence that follows — will tell gun owners everything they need to know about whether this administration's ATF intends to follow the law or rewrite it from the shadows.
