ATF Won't Tell You Which Braced Pistols Are Illegal—Until You're Arrested

GOA demanded a legal list. ATF's answer: you'll find out when you're sitting across from a federal prosecutor.

Gun Owners of America went straight to the ATF with the most basic question imaginable: now that Biden's rule is gone, which braced pistols still violate the NFA or the Gun Control Act?

The ATF refused to answer.

Not "we're reviewing it." Not "guidance is coming." Silence—followed by the chilling implication, according to GOA, that gun owners may not learn their firearm is "illegal" until they're facing a federal prosecutor.

**That is not regulatory ambiguity. That is a trap with a federal badge on it.**

No published list. No guidance document. No safe harbor. Just a loaded ambush waiting for the wrong gun owner on the wrong day—enforced selectively, in secret, after the fact.

This is the ATF's oldest and dirtiest play: manufacture legal fog, then use it as a weapon. If you can't know whether you're compliant, you can't defend yourself—legally or politically. The agency holds every card, and you hold the risk.

The Biden brace rule took years of regulatory warfare, cost gun owners millions in compliance anxiety, and was ultimately struck down. The ATF has zero interest in cleaning up the legal wreckage it left behind. Pre-existing NFA and GCA definitions—barrel length, overall length, stock-versus-brace classification—still apply. The agency reserves the right to make those calls case by case, in the dark, whenever it feels like it.

**"The brace ban is dead" does not mean "you are clear."**

GOA is pushing hard for written clarity. So far: more silence from an agency that spent years terrorizing law-abiding brace owners and now can't be bothered to publish the rules it's still enforcing.

Here's what you do right now. Document everything—purchase records, manufacturer specs, original configuration. Do not modify your firearm. Contact GOA and your congressional representatives and demand the ATF publish clear, written, publicly accessible guidance—or get out of the enforcement business entirely.

Because here's the principle that should make every gun owner's blood boil: **an agency that refuses to tell you the rules has no business arresting you for breaking them.**

Watch this space. GOA isn't letting this die quietly—and neither should you.
