ATF Won't Tell You Which Brace Is Illegal—Until You're Arrested

GOA forced the agency to show its hand. ATF's official position: you'll find out you're a felon when the cuffs go on.

Gun Owners of America went directly to ATF and asked the only question that matters: which braced pistols are still enforceable under the standing NFA and Gun Control Act?

ATF's answer, documented and on the record: We'll let you know when we charge you.

**Read that again.** That is not bureaucratic ambiguity. That is not a backlog. That is the deliberate, official policy of a federal law enforcement agency—keep gun owners blind to the rules, then drop the hammer at the moment of their choosing.

Here's the legal reality you need in your head right now: Trump's executive action killed the Biden-era brace rule. It did not kill ATF's underlying authority to classify certain braced pistols as short-barreled rifles under the NFA. The agency still runs case-by-case evaluations on individual firearms—and it flatly refuses to publish the criteria driving those calls.

That means millions of Americans who legally bought braced pistols, followed every rule they could find, and exhaled when the Biden rule collapsed could still be holding a federally regulated item they have no way of knowing is regulated.

**There is a word for a legal system where the law is secret until the moment of arrest.** It is not a word compatible with a constitutional republic.

GOA is calling it exactly what it is: a trap. ATF has turned ambiguity into a weapon. If the agency won't define the line, the line doesn't exist for you—it only exists for them, applied to whoever they decide to target, whenever they decide to move.

Acting AG Todd Blanche needs to hear from gun owners on this. DOJ cannot permit a federal agency to run a de facto gotcha system against law-abiding citizens. No published criteria. No enforcement. That is the standard a republic demands.

**What you do right now:** Contact your representative—today, not next week—and demand ATF publish a complete, specific list of braced configurations it considers NFA items, in writing, with public comment. Support GOA's legal push to force that transparency into the open. And if you have genuine questions about your specific firearm, get actual legal counsel—do not make modifications based on rumor or forum posts.

The Biden rule is dead. ATF's appetite for your guns is very much alive—and right now, it's hunting in the dark by design.

Watch this space. GOA isn't done pressing, and this fight is nowhere near over.
