ATF Won't Tell You If Your Brace Is Legal—Only Arrest Will
GOA demanded a compliance list. ATF refused—and admitted you may only learn your pistol brace is 'illegal' in handcuffs.
Courts killed the Biden pistol-brace rule. That should have been a clean win.
It wasn't.
Gun Owners of America went back to ATF with a simple question: now that the rule is gone, tell us which brace configurations are legal. ATF's answer was a bureaucratic middle finger—no list, no guidance, no clarity.
**Their actual answer? Find out when you're arrested.**
ATF officials floated the idea—openly, to GOA—that a gun owner might only discover their firearm is "illegal" once they're staring down federal charges. That is not a regulatory gray area. That is a trap with a federal badge on it.
Here's why this is worse than the Biden rule itself: at least that rule was a target you could fight in court. This is fog. Deliberate, weaponized fog.
The NFA's definition of a short-barreled rifle never left the books. ATF still has full discretion to argue that any braced pistol was "designed or redesigned" to be fired from the shoulder. That subjective standard was always there—Biden's rule just made the aggression explicit. With the rule vacated, enforcement snaps back to case-by-case ATF judgment.
Your judgment doesn't count. Only theirs does.
One overzealous field agent. One bad day at an ATF field office. One prosecutor looking to make a name. That's all it takes when the agency refuses to publish what's legal and has already told a major gun-rights organization it won't warn you first.

GOA is pushing for legislative relief, because waiting for the next ATF director to feel generous is not a compliance plan. The Home Defense and Competitive Shooting Act—or any brace-protection language with teeth—needs a floor vote. Congress has to write brace legality into statute, or this game of federal roulette never ends.
Until that happens: know your configuration. Document why you chose your brace and how you use it. Do not assume the collapse of the Biden rule made you untouchable—ATF just confirmed, on the record, that it didn't.
Call your representative today. Tell them ATF openly admitted it will not warn gun owners before prosecuting them. Tell them that is not how the rule of law works in a free country.
