ATF Won't Tell You If Your Brace Is Illegal—Until Arrest
GOA demanded a straight answer on which braced pistols are still illegal. ATF stonewalled—and hinted you'll find out in handcuffs.
Gun Owners of America went straight to the ATF with the simplest possible question: now that the Biden-era brace rule is gone, which braced pistols does the agency still consider illegal under the NFA and Gun Control Act?
The ATF refused to answer.
**Not "we're reviewing it." Not "guidance is coming." Refused.**
Worse, the agency signaled that gun owners may not discover their firearm constitutes a federal felony until they're already facing charges. Enforce first. Explain never. That's the ATF's current posture—out loud, to a federal gun rights organization, on the record.
This is the part of the brace saga most gun owners don't know yet—and the part that should keep them up at night.
Vacating the Biden rule felt like a clean win. It was a real win. But the ATF never surrendered its underlying authority to classify certain braced pistols as short-barreled rifles under older NFA and GCA frameworks that predate Biden's rule entirely. That authority didn't die in court. It's still loaded.
That means right now—today—you could be holding a legally purchased pistol with a factory-installed brace that the ATF has privately decided is a regulated SBR. The agency has zero obligation under its current posture to warn you before it acts. No letter. No list. No safe harbor.
**You are expected to guess. And if you guess wrong, the punishment is a federal felony.**
GOA is demanding explicit written guidance that gives gun owners a clear, binding safe harbor. The ATF is stonewalling. Acting AG Todd Blanche and the DOJ need to hear—loudly—that ambiguity-as-enforcement-strategy is not acceptable in a country with due process.
The long-term fix is statutory. The Home Defense and Competitive Shooting Act would enshrine pistol brace protections in law, beyond the reach of any future ATF rule or administration mood swing. Until that passes, your brace is only as legal as the ATF's current disposition—which, as GOA just found out, they won't even put in writing.
**The brace fight is not over. The Biden rule died—the ATF's appetite to criminalize law-abiding owners did not.** Contact your representatives. Demand the HDCSA. Don't let a bureaucratic non-answer become the thing that turns a gun owner into a felon.
