ATF Won't Define Illegal Braces — Until It's Too Late

Biden's brace rule is dead, but ATF keeps prosecuting gun owners while refusing to say who's next

WTF News April 24, 2026 📖 2 min read

Biden's catastrophic pistol brace rule is officially dead and buried. But according to Gun Owners of America, the ATF quietly continues to enforce NFA and Gun Control Act regulations against certain braced pistols — and the agency flatly refuses to identify which configurations put you in their crosshairs.

GOA pressed the ATF directly for clarity. The agency's response: figure it out yourself, or find out when we charge you.

Let that sink in. Federal agents threaten law-abiding gun owners with felony prosecution under rules they won't publicly define. That's not ambiguity — that's a trap.

This is the ATF operating exactly the way it always has: maximum enforcement power, minimum accountability. The Biden brace rule may be gone, but the bureaucrats who loved it still sit in their Washington offices, still draw federal paychecks, and still look for ways to turn peaceable gun owners into criminals.

Acting AG Todd Blanche needs to hear about this — loudly. The DOJ must order the ATF to publish clear, written guidance on exactly which braced pistol configurations remain legally compliant under existing NFA and GCA standards. No more deliberate vagueness. No more ambush prosecutions.

Gun owners followed the rules. Many registered their pistols, paid the fees, or modified their builds in good faith based on whatever guidance existed at the time. Now the ATF plays coy about who they're coming for next.

This is precisely why millions of Americans don't trust federal gun agencies. The ATF has a long institutional habit of inventing enforcement priorities on the fly and burying the legal basis in bureaucratic fog thick enough to choke on.

If you own a braced pistol, contact GOA and your congressional representatives today. Demand written ATF guidance — and demand it now. Congress has the power to defund ATF enforcement actions that lack clear statutory authority. It's time to remind them of that fact.

Don't wait for a knock on your door to find out where you stand.
