ATF Still Calling Some Braced Pistols SBRs After Losing in Court

Agency refuses to fully stand down on pistol brace reclassification despite court defeats

Despite courts striking down their unconstitutional attempt to reclassify tens of millions of braced pistols as Short Barreled Rifles overnight, ATF bureaucrats now claim that some braced firearms are STILL SBRs under existing law.

Let that sink in. The same agency that approved these braces for years — that told manufacturers and consumers they were perfectly legal — now argues that certain configurations were always illegal. They lost the battle but refuse to end the war.

This is bureaucratic gaslighting at its finest. The ATF greenlit pistol braces repeatedly through official determination letters. Gun owners purchased these accessories in good faith, trusting the agency's own guidance. Now the ATF wants to have it both ways: the rule is gone, but the threat remains.

While it was active, the brace rule would have turned an estimated 10 to 40 million legally purchased firearms into NFA items requiring registration, a $200 tax stamp, and months of waiting. Gun owners faced an impossible choice: register, destroy their property, or become instant felons.

Courts saw through this power grab and killed the rule. But the ATF's latest move signals the agency is not done playing games with Americans' constitutional rights.

This is exactly why gun rights organizations and Second Amendment attorneys warned that defeating the rule was not enough. The underlying problem remains: an unelected agency continues to reinterpret law on the fly, creating criminals with the stroke of a pen.

Acting Attorney General Todd Blanche needs to rein in this rogue agency immediately. The ATF cannot enforce through intimidation what it could not accomplish through rulemaking.
