ATF Pistol Brace Ban Is Dead — Here's What You Still Need to Know

Courts killed the ATF's 2023 power grab, but AR pistol owners can't afford to stop paying attention.

The ATF's 2023 pistol brace rule — the one that attempted to reclassify millions of legally owned AR pistols as unregistered short-barreled rifles overnight — is fully vacated as of 2025. Law-abiding gun owners won that round.

Federal courts saw through the ATF's regulatory sleight of hand and struck down a rule that would have turned ordinary Americans into felons for owning accessories the agency itself had blessed for over a decade. That's not regulation — that's entrapment.

But every AR pistol owner needs to understand this right now: the legal landscape is still shifting, and ignorance of the rules is not a defense.

If you're running a pistol brace on your AR, your firearm must meet specific barrel and overall length requirements to stay classified as a pistol under federal law. A barrel under 16 inches and an overall length under 26 inches keeps you in pistol territory — provided you haven't added a stock, which crosses into SBR classification and requires a Form 1 and a $200 tax stamp.

Acting AG Todd Blanche has signaled a less aggressive posture toward law-abiding gun owners than his predecessors, but the ATF's rulemaking apparatus remains intact. The bureaucracy still exists. New rules can still drop.

If you want to go the SBR route legally, manufacturers like Maxim Defense offer stock versions of their brace-equipped platforms. Filing a Form 1 through the NFA process is slow, but it gives you clean legal standing that no future ATF reversal can touch.

The brace ban is dead — but stay sharp. Know your measurements. Know your state laws, which may be stricter than federal standards. File your Form 1 if you're going SBR, because the next administration's ATF director may not be as friendly.

Keep your builds legal, keep your paperwork tight, and keep pressure on your representatives to permanently rein in ATF rulemaking authority.
