ATF Lost the Brace War—Now It's Trying a Backdoor

Courts killed the brace rule, but ATF claims some braced pistols are still SBRs. The fight isn't over.

After courts struck down the Biden-era regulation that overnight reclassified tens of millions of legally purchased braced pistols as short-barreled rifles, the ATF now claims certain braced firearms remain NFA-regulated SBRs regardless of the rule's fate. That's not compliance with the court's decision. That's a bureaucratic agency rewriting the law from the inside.

Here's what actually happened. The ATF spent years approving pistol brace configurations, collecting the implied tax revenue of industry compliance, and letting law-abiding Americans build their collections in good faith. Then, under pressure from anti-gun Democrats, the agency flipped the script—threatening millions of gun owners with felony charges overnight.

The legal community fought back hard. Courts gutted the rule, delivering a major victory for the Second Amendment community. Gun owners won. The rule died.

Now ATF bureaucrats are floating a new theory: that some braced pistols were always SBRs—brace rule or not—based on vague "objective design features." Translation: the agency wants to keep a backdoor open to prosecute gun owners it couldn't touch after losing in court.

Acting AG Todd Blanche and DOJ leadership need to rein in the ATF immediately. Approving a product, then criminalizing it, then losing in court, then trying to criminalize it again through a different angle—that's unaccountable federal overreach. Americans across the political spectrum should reject it.

The Second Amendment carries no asterisk. "Shall not be infringed" includes no footnote reading "unless ATF changes its mind."
