ATF Lost the Brace War—Now It's Playing Dirty
Courts killed the pistol brace rule, but the ATF still claims some braced pistols are SBRs. The fight isn't over.
Courts struck down the ATF's catastrophically overreaching pistol brace rule. The agency lost. But instead of standing down, it is now claiming that certain braced firearms still qualify as short-barreled rifles under existing statutes. Translation: the bureaucrats lost the battle and are fighting the war by other means.
Here's how we got here. The ATF spent years approving pistol brace designs, collecting fees, and letting law-abiding Americans build entire lawful collections around this equipment. Then, under the Biden administration, the agency reversed course overnight—threatening ordinary gun owners with felony charges for possessing firearms the government itself had green-lit.
The legal pushback was swift and decisive. Second Amendment advocates, firearms organizations, and gun owners across the country challenged the rule in court. It collapsed under judicial scrutiny, exposed for exactly what it was: a rogue agency rewriting federal law without congressional authority.
But Acting AG Todd Blanche and the current DOJ need to finish the job. The ATF's lingering position—that some braced pistols remain SBRs regardless of the rule's death—is a legal grenade with the pin still in it. Vague enforcement threats against law-abiding citizens are unacceptable and must end.
Tens of millions of Americans own braced pistols. They bought them legally. They followed the rules. The ATF keeping one foot in the door after losing in court is bureaucratic bad faith, plain and simple.
