ATF Lost in Court—Now They're Enforcing the Rule Anyway

Courts killed the brace rule, but ATF still insists your legal pistol may be an SBR

The ATF lost. A federal court killed their pistol brace rule. But the agency is already signaling it isn't finished targeting law-abiding gun owners.

Despite the rule's death, the ATF now claims certain braced pistols may still qualify as short-barreled rifles under the National Firearms Act—regardless of what any court said. That means tens of millions of Americans who legally purchased ATF-approved firearms could still find themselves in the agency's crosshairs.

Let that sink in. The ATF approved pistol braces for years. Manufacturers built products around ATF guidance. Americans spent their hard-earned money on legally compliant firearms. Then the Biden-era ATF flipped the script overnight, reclassifying those same guns as NFA-regulated SBRs and threatening owners with felony charges.

The rule covered an estimated tens of millions of legally purchased firearms. Courts struck it down as the regulatory overreach it always was. Gun rights advocates fought hard, and they won—in court.

Winning in court apparently isn't enough to stop this agency.

Acting AG Todd Blanche and the Trump DOJ need to put the ATF on a short leash now. The era of bureaucrats inventing felonies out of thin air to punish compliant gun owners has to end—not slow down, not pause, end.

The ATF cannot resurrect through back-channel enforcement what courts have already buried. That's not regulation—that's harassment of innocent Americans exercising a constitutional right.

The legal fight continues, and gun owners need to stay locked in. If you own a braced pistol, know your rights, document your purchase history, and support the organizations—GOA, FPC, SAF—still fighting this battle in court.
