That's not a gray area. That's a trap.
Yes, Trump's executive action killed Biden's catastrophic pistol brace rule — the one that overnight turned millions of law-abiding Americans into potential felons. That was a win. But the fight isn't over, and the ATF is making sure of it.
The agency still claims authority under pre-Biden NFA and Gun Control Act frameworks to classify certain braced pistols as short-barreled rifles. Which ones? They won't say. When GOA pushed for written guidance, the ATF stonewalled them.
Read that again: a federal law enforcement agency enforces criminal statutes while refusing to identify what conduct triggers those statutes. That's not regulation — that's ambush.
The Fifth Amendment guarantees Americans fair notice before the government criminalizes their behavior. The ATF ignores that guarantee when it has guns to confiscate and charges to file.
Acting AG Todd Blanche needs to answer for this. His Justice Department controls the ATF, and right now that agency runs a legal dark zone against innocent gun owners who purchased legal products, followed the rules, and still can't get a straight answer from Washington.
Congress must act. The Home Defense and Competitive Shooting Act would permanently protect pistol braces by statute — stripping the ATF of its reclassification authority entirely. If your representative hasn't co-sponsored it, call their office today and demand to know why not.
Brace owners shouldn't be guessing whether they're felons. The ATF knows exactly what it's doing — keeping law-abiding Americans in legal limbo is a feature, not a bug. Don't wait for a knock on your door to find out where you stand.
