ATF Built a Billion-Record Gun Registry. Congress Wants Answers.

Testimony at a recent Senate hearing confirmed what Second Amendment advocates have warned about for years: the Bureau of Alcohol, Tobacco, Firearms and Explosives built a searchable database of American gun owners — without congressional authorization and in direct violation of federal law prohibiting a national firearms registry.

This isn't a clerical accident. This is the same rogue agency that tried to criminalize millions of pistol-brace owners overnight, rewrote the definition of "engaged in the business" to ensnare private sellers, and redefined frames and receivers to manufacture new felons out of law-abiding citizens.

Litigation over those Biden-era power grabs continues grinding through federal courts in 2026. Acting AG Todd Blanche now oversees the DOJ, and gun owners deserve a clear answer on where his department stands on dismantling this bureaucratic surveillance apparatus.

The records come largely from out-of-business dealer logs — Form 4473s the ATF must store but cannot legally index into a searchable registry. Congress banned a national gun registry in 1986 for good reason. The ATF built one anyway and dared anyone to stop them.

Senators pressed ATF officials on how records are stored, who can access them, and whether the database identifies individual gun owners by name. The answers were unsatisfying at best and deliberately evasive at worst.

One billion records. Let that number sink in.

This is the infrastructure of confiscation. You do not build a billion-record database of firearms transactions to fight criminal violence — criminals don't fill out Form 4473s. You build it because you want to know who owns what, and where to find them.

Congress must act immediately: defund ATF's records digitization program, mandate destruction of illegally indexed data, and pass enforceable criminal penalties for any federal employee who builds or maintains an unauthorized gun registry.
