6 States Ban Red Flag Laws — And Will Punish Officials Who Enforce Them
States are criminalizing ERPO enforcement and protecting gun owners from no-due-process confiscation — here's what the anti-gun lobby won't tell you.
Six states have banned enforcement of so-called 'extreme risk protection orders' — and some are putting officials in legal jeopardy if they try to enforce them anyway.
That's the bombshell buried inside a panicked newsletter from The Trace, the anti-gun advocacy outfit disguised as a news organization. They're not happy about it. We are.
ERPOs — better known as red flag laws — strip law-abiding Americans of their firearms based on unverified accusations, with zero criminal charge, zero conviction, and zero meaningful due process. A judge can order your guns seized before you ever set foot in a courtroom to defend yourself.
The Trace calls concerns about misuse 'false claims.' That's not analysis — that's spin. Innocent gun owners across the country have had their rights vaporized on the word of a bitter ex, an estranged family member, or an overzealous bureaucrat. That's documented reality.
Now states are fighting back. Six legislatures looked at these unconstitutional confiscation schemes and said: not here. Some went further, making it a punishable offense for local officials to carry out ERPO orders. That's not extreme — that's protecting your constituents.
The left loves to remind you that Trump and the NRA once gave ERPOs a second look after Parkland. What they won't tell you is that the gun rights community examined the details, saw the due process catastrophe hiding inside, and course-corrected. That's called learning. The anti-gun crowd never does.
Acting AG Todd Blanche and the Justice Department should watch this state-level pushback closely. The Second Amendment has no asterisk reading 'unless someone makes an accusation.' Bruen made that crystal clear — laws that deviate from America's historical tradition of firearm regulation don't survive scrutiny.
The momentum is real and moving in the right direction. Six states have drawn the line. The rest need to follow.
